1. Description of Service

Xavior is an AI-powered personal assistant and workspace platform. It helps you organize information, manage contacts, track tasks, handle email, schedule events, and run your day using AI-powered tools and integrations.

Xavior connects to third-party services (such as Google, Whoop, Strava, and Fitbit) to sync and display your data in a unified workspace. It uses AI providers (Anthropic Claude and OpenAI) to deliver intelligent assistance, and Brave Search for web search capabilities.

2. Account Responsibilities

When you create an account, you agree to:

• Provide accurate and complete information
• Keep your login credentials secure
• Be responsible for all activity under your account
• Notify us immediately of any unauthorized access
• Be at least 18 years old or have the authority to agree to these terms

You are responsible for ensuring you have the right to upload, store, and process any data you provide to Xavior.

3. Acceptable Use Policy

You may not use Xavior to:

• Plan, commit, or assist in illegal activities
• Hack, scam, defraud, or steal
• Violate privacy or surveillance laws
• Upload or store illegal content
• Circumvent law enforcement or security systems
• Abuse or overload the system
• Attempt to access data that is not yours
• Reverse engineer or exploit the service
• Bypass rate limits or safeguards
• Use Xavior to harm others

You are responsible for your searches, uploads, and actions. If we believe Xavior is being used illegally or abusively, we may suspend or terminate your access immediately.

4. Third-Party Integrations

Xavior integrates with the following third-party services. By connecting these services, you agree to comply with their respective terms:

Google Workspace

Xavior connects to Google services including Gmail, Google Calendar, Google Drive, and Google Contacts. When you connect Google:

• You authorize Xavior to access your Google data as described in our Privacy Policy
• Google's Terms of Service also apply to your use of Google data
• Xavior's use of Google data complies with the Google API Services User Data Policy, including the Limited Use requirements
• You can disconnect Google at any time to stop data sync

AI Providers

• Anthropic (Claude): Powers Xavior's primary AI capabilities. Your conversation content is processed by Claude to deliver intelligent assistance. Subject to Anthropic's Acceptable Use Policy.
• OpenAI: Available as an alternative AI provider. Subject to OpenAI's Terms of Use.

Search

• Brave Search: Used for web search capabilities. Search queries are sent to Brave's API. Subject to Brave's Terms of Use.

Health and Fitness

• Whoop: Syncs heart rate, strain, recovery, and sleep data. Subject to WHOOP's Terms of Service.
• Strava: Syncs workouts, routes, and performance metrics. Subject to Strava's Terms of Service.
• Fitbit: Syncs activity, sleep, and heart rate data. Subject to Fitbit's Terms of Service.

We are not responsible for the availability, accuracy, or behavior of third-party services. If a third-party service changes or discontinues its API, the corresponding Xavior features may be affected.

5. AI-Generated Content Disclaimer

AI responses may be:

• Inaccurate or incomplete
• Misleading or out of date
• Based on hallucinated facts

Do not rely on Xavior for decisions involving:

• Financial, legal, or tax matters
• Medical or health decisions
• Safety-critical actions

Always verify important information independently. You are solely responsible for how you use AI-generated output. Xavior is not a lawyer, doctor, financial advisor, or source of guaranteed truth.

6. Intellectual Property

Your Content

You own your data. We do not claim ownership of your notes, documents, files, contacts, tasks, events, conversation history, or data synced from third-party services. We only have a limited license to process your data in order to provide the service.

Our Service

The Xavior platform, including its software, design, branding, and documentation, is the intellectual property of XAVIOR Inc. You may not copy, modify, distribute, or reverse engineer any part of the service without our written permission.

7. Data and Privacy

Your use of Xavior is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your data.

Key points:

• Your data is stored in per-user isolated databases
• We do not sell your data or use it for advertising
• You can export, delete, or disconnect your data at any time
• AI providers process data only for the duration of API requests

You are responsible for backing up your data. We do not guarantee that your data will never be lost, corrupted, or become inaccessible.

8. Service Availability and Modifications

Xavior may:

• Change, add, or remove features at any time
• Update pricing with advance notice
• Experience downtime for maintenance or unforeseen issues
• Pause or discontinue the service entirely

We do not guarantee uptime or uninterrupted availability. We will make reasonable efforts to notify you of significant changes.

9. Payments and Subscriptions

Xavior is a paid service. By subscribing:

• You agree to pay the fees for your selected plan
• Payments are processed through Stripe
• Subscriptions renew automatically unless cancelled
• Refunds are handled on a case-by-case basis

Prices may change. We will notify you before any price increases take effect.

10. Limitation of Liability

Xavior is provided "as is" and "as available," without warranties of any kind, express or implied.

To the maximum extent permitted by law:

• We are not liable for lost data, lost profits, or indirect, incidental, special, or consequential damages
• We are not liable for the accuracy, reliability, or completeness of AI-generated content
• We are not liable for the actions or availability of third-party services
• We are not liable for losses caused by security incidents, despite our reasonable security measures

If we are found liable for anything, our total liability is limited to the amount you paid us in the last 12 months (or $100 if you paid nothing).

11. Indemnification

If your use of Xavior causes legal claims, damages, or costs against us, you agree to indemnify and defend XAVIOR Inc. from such claims. This includes claims arising from your content, your use of third-party integrations, or your violation of these terms.

12. Termination

We may suspend or terminate your access if:

• You violate these terms
• You use Xavior illegally or abusively
• We believe continued access creates risk
• Your payment fails repeatedly

You may cancel your account at any time. After termination, your data is retained for 30 days and then permanently deleted. You may request immediate deletion.

13. Governing Law

These terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules. Any disputes arising from these terms will be resolved in the courts of Wyoming.

14. Changes to These Terms

We may update these terms from time to time. If changes are significant, we will notify you via email or through the service. Continued use of Xavior after changes constitutes acceptance of the updated terms.
